Initial Resolution for General Obligation School Building Bonds
INITIAL RESOLUTION FOR GENERAL OBLIGATION SCHOOL BUILDING BONDS
BE IT RESOLVED by the School Board of Grand Forks Public School District No. 1 of Grand Forks County, North Dakota (the “School District”), that it is necessary and expedient for the School District to issue its general obligation school building bonds as hereafter described:
- The maximum amount of bonds proposed to be issued is $79,000,000.
- The purpose for which the bonds are proposed to be issued is to provide funds, together with any other funds available, to construct and equip a new Valley Middle School; demolish the existing Valley Middle School; construct and modernize the child nutrition facility; construct and equip safety and security facilities; and to otherwise improve and renovate school property.
- The assessed valuation of all taxable property in the School District as defined in N.D.C.C. § 21-03-01, is $$2,866,971,012 as last finally equalized for the year 2022.
- The total amount of bonded indebtedness of the School District, all issued for school building purposes, is $34,793,200.

The motion for the adoption of the foregoing resolution was duly made by Member Jeff Manley, seconded by Member Joel Larson, and upon vote being taken thereon, the following voted in favor Josh Anderson, Dave Berger, Amber Flynn, Monte Gaukler, Joel Larson, Eric Lunn, Jeff Manley, Bill Palmiscno, Cynthia Shabb; whereupon said resolution was declared duly passed and adopted and was signed by the President and attested by the Business Manager.
Resolution Calling a Special Election to Vote on the Question of Approving an Initial Resolution for General Obligation School Building Bonds
RESOLUTION CALLING A SPECIAL ELECTION TO VOTE ON THE QUESTION OF APPROVING AN INITIAL RESOLUTION FOR GENERAL OBLIGATION SCHOOL BUILDING BONDS
BE IT RESOLVED by the School Board of Grand Forks Public School District No. 1 of Grand Forks County, North Dakota (the "School District"), as follows:
- This Board has heretofore adopted an initial resolution proposing the issuance of general obligation bonds of the School District in the principal amount of $79,000,000 for school building construction purposes. A special election is hereby called to be held on Tuesday, May 16, 2023, for the purpose of submitting to the qualified voters of the School District the question of whether the initial resolution for general obligation school building bonds should be approved.
- Pursuant to Section 15.1-09-13 of the North Dakota Century Code, the Board hereby designates one precinct for the election and one polling
- The polling place for said election shall be: the Alerus Center (1200 S 42nd St., Grand Forks, ND). The polls will be open at 7 a.m., Central Time, and shall remain open continuously thereafter until 7 p.m., Central Time.
- The School Board authorizes the administration to employ individuals to act as the election officers of said election. Said election officers shall count the votes cast at said election and shall submit signed election returns to this Board for canvassing
- The Business Manager is hereby authorized and directed to cause typed or printed ballots to be prepared for use at said special election which ballots shall be in substantially the following form:

QUESTION #1 Shall Grand Forks Public School District No. 1 of Grand Forks County, North Dakota, issue its general obligation bonds in the amount not to exceed $79,000,000 maturing within a maximum of 20 years, resulting in an estimated additional millage of 21.54 mills, equal to $21.54 on each $1,000 of taxable valuation for the first taxable year, for the purpose of providing funds, together with any other funds available, to construct and equip a new Valley Middle School; demolish the existing Valley Middle School; construct and modernize the child nutrition facility; construct and equip safety and security facilities; and to otherwise improve and renovate school property. INSTRUCTIONS TO VOTERS:
Voters desiring to vote in favor of the foregoing propositions should mark a cross (X) in the space opposite the word " Yes." Voters desiring to vote against such propositions should mark a cross (X) in the space opposite the word "No.'
- The Business Manager is hereby authorized and directed to give notice of said special election by:
- causing a notice thereof to be published once each week for at least two weeks in the official newspaper of the School District, the first of such publications to be at least 15 days before the date of said election; and
- posting the notice of special election on the website of the School District prior to the date of said election.
Said notice shall state the date of the election, the polling places and polling hours, shall contain a complete copy of the initial bond resolution, a statement that the question to be submitted at said election shall be whether said initial resolution shall be approved, and the estimated additional millage and equivalent dollar amount on each $1,000 of taxable valuation for the first taxable year after all of the bonds are issued.
- The election shall be held and conducted in accordance with the provisions of Chapter 15.1-09 of the North Dakota Century Code. After the votes are canvassed, and, within 24 hours after the polls are closed, the judges shall make their returns to the Business Manager of the School District, and the School Board shall meet on May 29, 2023, at 6 p.m., the 13th day after the polls are closed, for the purpose of canvassing the returns and declaring the results and taking such further action relative to the questions voted on as may then be determined appropriate.

Resolution Authorizing School Construction Loan Application
RESOLUTION AUTHORIZING SCHOOL CONSTRUCTION LOAN APPLICATION
WHEREAS, Section 15.1-36-08 of the North Dakota Century Code (“N.D.C.C.”) establishes a revolving loan fund for school construction loans and requires that a completed loan application be submitted to the Bank of North Dakota; and
WHEREAS, Grand Forks Public School District No. 1, Grand Forks County, North Dakota (the “School District”) has scheduled a special election to be held on May 16, 2023, for the purpose of submitting to the voters of the School District the question as to whether or not the School District should issue general obligation bonds in the amount of $79,000,000 for the purpose of providing funds to construct and equip a new Valley Middle School; demolish the existing Valley Middle School; construct and modernize the child nutrition facility; construct and equip safety and security facilities; and generally to renovate, remodel, equip and improve school buildings, school property and school facilities (the “Projects”); and
WHEREAS, the School Board finds it is in the best interest of the School District to submit a School Construction Loan Application to the Department of Public Instruction to, in part, finance the Projects with the proceeds of a state school construction fund loan;
NOW, THEREFORE, BE IT RESOLVED by the School Board of the School District, as follows:
- The School District, pursuant to Section 15.1-36-08, N.D.C.C., shall apply for a state school construction fund loan to provide funds to, in part, finance the Projects and hereby authorizes the President of the School Board to execute the School Construction Loan Application, in the form attached hereto, with such changes and modifications as may be required and approved by the President, on behalf of the School District.
- The School Board hereby authorizes the Business Manager of the School District to submit to the Department of Public Instruction the School Construction Loan Application signed by the President of the School Board together with all other documentation and information required by the Department of Public Instruction for the loan application.
